Premium Pay Administration Handbook

Topics covered include:

INTRODUCTION

Covers the reasons for passage, impact on fiscal resources, complexity of application, and the impact on management responsibility of the FEPA premium and overtime pay provisions.

COVERAGE

Discusses geographic, agency and employee coverage, and those positions that excluded from FEPA or Title 5 coverage.

HOURS OF WORK UNDER FEPA

Examines the impact of scheduling decisions on entitlement to premium and overtime compensation as well as guidelines to assist managers in establishing work schedules. It also covers the impact of alternative work schedules on premium and overtime compensation eligibility.

MAXIMUM EARNINGS LIMITATIONS

Considers the aggregate annual limitation on pay, and looks at both the biweekly and annual limitation on premium pay under FEPA. Also reviews earnings limitations during emergencies, mission critical work, and on certain forms of premium payments.

OVERTIME UNDER THE FEPA

This section defines overtime and hours of work needed to qualify for overtime compensation. It discusses the impact of flexible and compressed work schedules, and fractional hours of work. The two forms of FEPA overtime compensation – pay and compensatory time off – are covered. Also covered are two separate forms of compensatory time off unrelated to overtime, i.e., compensatory time off for time spent in travel, and for religious purposes.

DIFFERENTIALS AND PREMIUM PAY UNDER FEPA

Two chapters that cover the individual forms of premium pay, i.e., night, Sunday, holiday, and duty involving physical hardship or hazard in one chapter; and premium pay paid on an annual basis, i.e., regularly scheduled standby duty, administratively uncontrollable work (AUO), and law enforcement availability pay (LEAP) in another chapter. The material covers eligibility requirements for each form of premium pay, and the rates at which the premium pays are compensated.

OTHER TOPICS

The FEPA compliance and claim processes, including agency, U.S. Office of Personnel Management (OPM), and Federal Court reviews are examined. Also reviewed is the topic of back pay calculations, including determining entitlement to back pay and computing back pay.
